Terms of Use

1. Who we are and what these terms cover

These terms apply to the Kitty app for iPhone and to this website. Kitty is provided by Portionscore UG (haftungsbeschränkt), Hornbühlstraße 5, 79117 Freiburg im Breisgau, Germany (“we”). For the app, Apple's Licensed Application End User License Agreement also applies.

2. What Kitty is, and what it isn't

Kitty helps you keep track of what you eat and of your weight, and estimates your daily energy needs. Kitty is not a medical device, doesn't give medical advice and doesn't replace a doctor or dietitian. All nutrition values, portion estimates and goals are approximations and can differ from what you actually ate.

Please talk to a doctor before using Kitty if you're pregnant or breastfeeding, under 18, have a medical condition or have ever had an eating disorder. If tracking makes you feel worse, take a break and talk to someone you trust or a doctor.

3. Who can use Kitty

You must be at least 16 years old to use Kitty.

4. Your account

Kitty creates an account for you automatically, without an email address or password. Your data is linked to this account. If you delete the app without deleting your account first, you may lose access to your data.

5. Subscription, free trial and cancellation

• Kitty's features are available with a paid subscription that you buy through Apple's App Store. Without an active subscription or free trial, the app can't be used beyond setup.
• The price, the billing period and whether a free trial is offered are shown in the app before you buy. Payment is charged to your Apple ID when you confirm the purchase.
• The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. The renewal is charged to your Apple ID within the 24 hours before the period ends.
• A free trial turns into a paid subscription unless you cancel it at least 24 hours before it ends. If you buy a subscription during a free trial, the rest of the trial is forfeited.
• You can manage and cancel your subscription in your Apple ID settings: Settings, your name, Subscriptions. Deleting the app doesn't cancel your subscription.
• Apple sells the subscription. Payment, refunds and any statutory right of withdrawal are governed by Apple's terms. You can request a refund at reportaproblem.apple.com.

6. AI features

Photo analysis, voice input, chat and meal ideas use artificial intelligence. AI can make mistakes: it can misidentify foods, misjudge amounts or suggest meals that don't suit you. Please check results before you log them, and don't follow suggestions that conflict with your health, allergies or intolerances. Kitty doesn't check meals for allergens.

To protect the service from misuse, AI features have daily fair-use limits. Recipe links lead to websites of third parties, whose content we're not responsible for.

7. Fair play

Please don't misuse Kitty. In particular, you may not use Kitty in a way that breaks the law, try to access our systems or other people's data without permission, access the service automatically (for example with bots or scrapers) or overload it, reverse-engineer the app beyond what the law allows, or send content to the chat that is illegal, abusive or infringes the rights of others.

8. Your content

Your photos, recordings, messages and entries remain yours. You allow us to process them only as far as needed to provide Kitty. Details are in our Privacy Policy.

9. Changes and availability

We keep improving Kitty and may change, add or remove features as long as this is reasonable for you and Kitty's core purpose, tracking food and weight, stays intact. We aim for high availability but can't guarantee uninterrupted operation, for example during maintenance or outages of our service providers.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee. For slight negligence, we're only liable if we breach an obligation that is essential to the contract, meaning one that makes proper performance possible in the first place and on which you may regularly rely. In that case our liability is limited to the typical, foreseeable damage. Otherwise our liability is excluded. These limits also apply to our employees and agents.

11. Ending the use

You can stop using Kitty at any time and delete your account in the app. Your subscription has to be canceled separately with Apple. We may block access if you seriously violate these terms.

12. Changes to these terms

We may update these terms for a valid reason, for example new features or changes in the law. We'll tell you about material changes in the app in advance. Changes that significantly affect your rights or your subscription only apply with your consent.

13. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you're a consumer living in the EU, the mandatory consumer protection rules of your country of residence also apply. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If a provision of these terms is invalid, the rest remains valid.
